共同财产 mutual property-英语点津

《婚姻法》最新司法解释的颁布可谓一石激起千层浪，其中有关房产分割的处理更被指会推高离婚率。结婚前看有没有房，离婚时吵房子归谁，究竟是感情的错，还是房价的错？这原本就是一个伪命题，因为把婚姻绑架在房子上本身就是一种悲哀。

A controversial section of the draft suggests that once a marriage ends in divorce the pre-marital property is to be recognized as the buyer's personal assets, instead of a couple's common wealth.

征求意见稿中一个条款颇具争议，该条款指出，离婚时婚前房产将被认定为购买者的个人财产，而不是夫妻共同财产。

我们再来看看原来是如何规定的：

The previous clause in the law dictated that a house, which is traditionally bought by the bridegroom before the marriage, is regarded as the couple's mutual property and appraised for its value on divorce.

（《婚姻法》）之前的条款规定，传统上由男方在婚前购买的房产在离婚时被认定为夫妻的共同财产，并接受估价。

上文中的common wealth和mutual property都是指夫妻的“共同财产”，是与personal assets（个人财产）和pre-marital property（婚前财产）相对而言的。为防止婚后因经济等问题产生纠纷，如今更多年轻人选择签订prenuptial agreement/prenup（婚前协议），或者进行pre-marital property notarization（婚前财产公证）。

虽然人们不在受制于旧时的arranged marriage（包办婚姻），但仍有不少人对婚姻缺乏安全感，一些年轻人由于担心婚后出现问题，在婚前长期进行companionate marriage（试婚，同居），反而增加了日后的风险，而另一些人则欣然接受flash marriage（闪婚）。夫妻在婚后接受marital counseling（婚姻咨询）对两人的关系很有好处。
