自带酒水去酒楼,然后对老板收取“开瓶费”的要求说“NO”?不行!至少法律上行不通。
备受关注的北京首例“开瓶费”终审判决如下:酒店退还消费者“100元开瓶费”,但判决的理由是酒楼没有收费“明示”。这将意味着,有收费“明示”的酒店可以向消费者合法索要“开瓶费”。

The Beijing No.1 Intermediate People's Court is at odds with the grounds of
the decision the Haidian District Court adopted in the first instance on Dec 21,
2006 that a restaurant must return the corkage fee to one of its customers,
reported the Beijing Times on Wednesday.
报道中的“corkage fee”指的就是“开瓶费”,指“酒店向自带酒水的消费者收取开瓶服务费”。有时,仅用“corkage”一词也可表示“开瓶费”。
“Corkage”源于名词“cork”(瓶塞),相应的,其动词形式“cork”则表示“用瓶塞塞住”,如:to cork the wine
securely(将酒封得严严实实)。源于此,口语中,“闭嘴”可表达为“Put a cork in it! ”
